I think thats speculation. If he IS doing that.. then this will definitely curb that eh? There needs to be a 45 second cooldown timer on re-cloaking just like every other game's invisibility.
Of course it's speculation... just like it's speculation that a cloaked Jedi would hang around a given recruiter for hours in the hopes that he could gank the one guy who sticks around for more than 30 seconds after declaring...
I've seen some stupid Jedi in the past, but none THAT stupid. Such a Jedi is guaranteed to attract people who want to gank HIM - they are called "Bounty Hunters".
My point is that people who get ganked while delegating faction tend to do so because they have drawn too much attention to themselves. A smuggler should be discreet and always a bit suspicious. Sounds like this fellow was neither.
mmmm.....sad is all I can say...
I was a faction smuggler pre-curb, one of the only imp ones on my server....that meant I logged in every day OVERT but unbuffed.....I loved it (you really have to sneak around...nice suspense if you have to go to starports to travel and such).
then SOE changed some faction stuff, effectively killing half my business (faction perks)
they raised the cap of FP you could hold
they dropped the cap of 500 FP over which you could not buy faction.
in the old system you needed 2 smugglers, one of any race who buys then delegates, and one HUMAN master smuggler who then buys the base...
due to above change from then on the whole faction perk market belonged to HUMAN smugglers, as they could now but the perks all by themselves, cheaper than ever before.....
if THAT had happened to you you might have a reason to complain.....now you're just whining because you can not accept the dangers of being a faction smuggler
On topic, don't sell faction out in the open. PERIOD. Bad form. I see some smugglers running macros shouting "Selling X faction for X price" come on now. Are you a smuggler or a merchant? Also since we have to go SF to sell, best to do it somewhere safe. In someways it is a better roleplay experience for the other player.
Now, to mister RED=DEAD! Dude people like you who grief people like that are just as bad as jedi... if you aren't already one. What is the point of killing a smuggler anyway? What so you can brag... Oh I snuck on someone a killed them... OOOO I am so uber!!!! Take another trip around the bowl... you need it.

more importantly I have to question the intelligence of someone being surprised jumped from the cloner, comming back.. being surprised jumped AGAIN... barely escaping a 3rd time and not having his friends warn anyone else in the area. And what about the feign death guy? He couldnt see a red dot on his radar? Not that I am a fan of jedi in the least, but maybe he should jedi grind just a littlebit.. just so he pays more attention to whats going on around him. Selling faction in and of itself doesnt make sense without roleplay. You arent selling a product. You are selling someone a higher reputation in order to gain rank. Exactly where is a store you can go buy reputation? But even in our society reputation CAN be purchased.. but its backroom deals and hookups where people are introduced to other people. Faction selling is a VERY valuable roleplay tool that is often ignored. just my 2 cents.

I thought it was covert, and I'm pretty sure that I read it in the patch notes when the big psuedo-revamp happened about 5 months ago.
Actually I'm pretty sure that even before that, you were returned to covert if you did a /pvp or declared at a recruiter.
That aside, if you aren't set back to covert, camping the cloner is really a low class thing to do.
In my mind, it's basically the same as saying 'hey, lets carpetbomb the hospital, they're treating the enemy there'.

you are set on leave (same as the old covert) when you die. The smuggler was trying to delegate faction so he kept re-aquiring special forces (overt) to delegate faction. After being killed twice you would think he would find a less busy place if he didnt want to fight.
