in the announcements too, all players that haven't got the JTL expansion get it for free now, wish i hadn't bothered lol

This is pretty much a fact of life. Initial sells are always the main payout. I bet you all those folks who dropped 20K for the Uber HD Flatscreen TV's that are now easily 1/4 that price hate themselves too. I got my Video card for $70, when it first came out it was $300. The reward of getting first and staying on the cutting edge is more costly than than patience.

It doesn't matter that SOE has more money than a single player.

All we need is a group of lawyers that bring a class action lawsuit. Multiply the number of players X 15$/month X months X expansions purchased and wave that a lawyer who will take the case for 33% of the settlement. Sony has been sued for lots of money in the past. The last one I remember was for screwing people over on the cost of CDs.

Oh, and that crappy user agreement doesn't mean anything. You can sue people whenever you want and drag them to court. It could figure into the final decision somehow, but the key is to make it painful for SOE to take it that far and make them settle out of court. Wouldn't it be funny if in arbitration we just asked SOE to forget about the NGE?

I'm not a lawyer and I'm sure that there is more to it, but not that much more. All you need is a lawyer that sees the cash potential

You sound American. I am too so I know the Sue em all attitude. If the EULA, user agreements, ect were so weak, software companies would go bankrupt all the time. No one would touch something that easy to get sued over. Look at Doctors. The craze of malpracovce suites drove the price if insurance to ungodly levels, now normal folk have a hard time getting decent insurence, even through thier companies. Doctors moved about a lot too, avoiding cities / states that allowed alot of weak suites to pass through. While this did adversly affect those who were truly hurt, the doctors could not help it, as thier own costs to practice were / are ridiculously high for malpractice insurance.

You would also be surprised at how many of these cases get dropped. Keep in mind as well, though not as likely, if found that SOE was in the right, they can counter sue for damages to thier name ect. It's just not worth it in that method.

Boycotts, Writing your congressmen, ect are much more effective. These lead to companies changeing thier policies, and states cracking down on companies...but as I said, It won't happen in Texas, Companies < people.

If someone really wants to do this:

1) Start a website we can sign up on so you can gather contact information

2) Find a lawyer who wants to make a name for him/herself

3) Get ready for a long fight.

Yes, we can sue. No, it won't be easy. No, the EULA/etc. does not grant immunity to a company for behavior like this.

A class action suite can take years btw...so yeas a long fight. They'd probly fight to take it down to arbitration, so individual claimes would need to be made, and thus more time taken.

Actually 2 class action suits against SONY right now. This has to do with SONY BMG and the rootkits they installed on everyone's computer.

Link

Apparently there are two class action suits filed, one in New York, the other in California alleging computer fraud, common law fraud and violations of the computer spyware act

Fact:

dispite your dissatisfaction of the game you continually clicked the "I agree" button everytime you played SWG.

Fact:

By pressing that button you were satisfied with your experience in that time....otherwise you would have quit pressing that "I agree" button long ago.

I doubt you'd win because basically you are saying "I hated what they were doing BUT I decided to play it and have fun anyway."

Plus, this NGE was pushed by LA as the starter and not SOE. SOE has to do what the people with the copyright TELL them to do. copyright=iron chain.

Has anyone actually contacted SOE and ASKED for a refund?

Before you start gettin all litigious, I'd recommend submitting a simple refund request. If its not granted, enlist the aid of your credit card company.

In my case, I bought my ToOW with my Platinum Sony VISA card. If I don't get some customer sassifaction, poo is gonna hit the fan on that one.
