If someone really wants to do this:
1) Start a website we can sign up on so you can gather contact information
2) Find a lawyer who wants to make a name for him/herself
3) Get ready for a long fight.
Yes, we can sue. No, it won't be easy. No, the EULA/etc. does not grant immunity to a company for behavior like this.

sounds like a plan
for those friends we have overseas and dont truly understand the legal process of u.s. courts. when class actions are brought around or even in this case will be a class action by a goverment agency towards a company for shady business practices the monies awarded are not just awarded on how much you have paid for the games and your subscriptions. Most of the damages are imposed to keep the company from doing it again to future customers. IE. microsoft damages assesed for anti trust violations to other software makers was about 15% for the loss of income to vendors other than microsoft and the other 85% was awarded to the goverment as a type of fine for doing bad business practices. Never think that 100%the monies assesed in finesgo directly to customers or the amount of fined levied is based on that figure of revenue gains....the majority of it goes to the goverment for having to prosecute the case and as a penalty not to do it again.
as a side note on the one post about sony getting sued, that is the sony music division which is secretly putting a tracking type program onto their music cd's that when you copy a sony label cd it leaves a spyware onto the new cd and can track copies and buying habits of the users. this is being looked into because sony did not tell anyone that they are doing it and violated customer trust..hmm, sounds familiar. In my research the most interesting suit against sony, and probably soe now, is the suit from a family who's son got "addicted" to the WOW. This guy quit his job, alienated himself from his family, and eventually commited suicide over some game issue....the family is suing because soe doesnt have a warning label on the box saying these types of games have the potential to be "addictive". Beleive it or not.
