1-4 SECTION 1. Section 17.46(b), Business & Commerce Code, is
1-5 amended to read as follows:
1-6 (b) Except as provided in Subsection (d) of this section,
1-7 the term "false, misleading, or deceptive acts or practices"
1-8 includes, but is not limited to, the following acts:
5-6 (23) the failure to disclose information concerning
5-7 goods or services which was known at the time of the transaction if
5-8 such failure to disclose such information was intended to induce
5-9 the consumer into a transaction into which the consumer would not
5-10 have entered had the information been disclosed;

Anyone who played this gamesince pre cuwith the notion of being an alpha class jedi could probably get their money back . Jedi was setup to be a time sink/money sink for players with the promise of being a strong class .There was no indication of them doing what they are doing to the game ,there was no reason for them to nerf the classes power like they did post cu. That falls under lies& deception , false pretences , the act of leading people to beleive one thing and doing the complete opposite of it , and still taking their money..I could probably dig up a dev quote saying jedi would have a 20-1 power over other players and bury them with just that statement in court.
They think the clause in their eula might save them where it says they may change or otherwise "ENHANCE" gameplay . All people would have to do is prove the so-called"enhancement" was a degradation to the court . Shouldnt be too hard..

In the end SOE > you. They have money, they have lawyers.They have thier EULA. This if you read it all, covers them pretty well. It leaves them with plenty of wiggle room. One main point, you do not own the software, they do, they can change what they wnat with it. Just like, if I wanted, I couldput all kinds of offensive stuff in my house, without reprocussion.At anytime if you do not agree with SOE's practices, just hit I disagree.
Asides Texas = Republican = Big Buisness > the Little guy. Texas is one of the States that capped Damages paid out by companies to protect the companies. Many Policies here are granted to enhance the power / protection of companies. I say Bleh to that, but I am in the minority here.
Not that I supporta refund, as I am quite satisfied with SOE myself. Been with them Since EQ, and will continue. I have read and understand the EULA. It follows the same for most Games as well.
If it helps, Just pretend the game you played closed down, and now you should search for a substitute. Hearing the o so famous "I am going to sue" " Fraud" "Switch and Bait" ect gets old. How do you know the Dev's were not just thrown this from LA for example. It could be played that way, heck anyway they wanna. LA could say they threw it at em last min as they felt that the game wasn't living up to the agreed upon trems, so said "Fix it now!" There is little you can do.
