Thats the way it use to work but I havent heard of anyone looting anything Exceptional or Legendary since the CU came out.

both exceptional and legendary items stopped dropping with the CU entirely

oh and thanks everyone for your posts so far, and for the record, I've looted about 5 stacks of acklay bones since posting this, best I've gotten so far is +92 max but am hoping.....still hoping....

and btw, +32 agents?!?!?!!? I've only ever seen around +25 myself, but ye gods if I could get my hands on some of those!
