Ok if I get this right
You cannot progress to level 3 because of the level 3 cap
A level 4 slot opened and none of the level 3's care to progress to level 4 hence opening up the level 3 spot for you.
That does ont sound like a bug.
Get in touch with one of those mayors of the level 3's that are close to 4 and nudge them to get their butts in gear and progress. Tell them your plight.
If they want to stay level 3, help them with temporary citizens for one week so they progress, you grow to 3 and then let them reduce back down the next cycle by moveing the temproary citizens back to your city.
There are ways around this
