I don't really thing the Episode III fighters will be privateer-only. For one, that really wouldn't be fair. And two, it just wouldn't make any sense.
They'll probably be certified for each faction to use (I pray), or atleast devided up... ARC for Rebels, Jedi starfighter for privateers, Grevious' fighter for Imperials.
But it's hard to say until we get more information. But no doubt we'll be getting more ships in RotW, and privateer ships will probably be one of them (and hopefully another Rebel craft, seeing as there's only two. Perhaps a modified B-Wing 
).

After thinking about it, and hoping. Maybe all the EP3 ships will be like the firespray, and be spread out in the tree's, based on there strength. After all we are talking about ships from the same "era" as the firespray, so why not? It would make good marketing sense to do it that way as well, to capitalize on the EP3 release. The nuetrals could get an imporved (gasp) dunelizard, and a couple other craft upgraded. Maybe the neutralscould get all new (not EP3 fighters, from another faction, who knows).

Im thinking some of these fighters will somehow be tied to prestige points, or be dropped schamatics like the firespray.

Well, I think it would make no sense for the rebels to fly any of these ships sans the modified X and Z-95. From a new hope on did you see any rebel pilot fly anything other than an X, Y, B, or A? No. I mean it's pretty obvious that the ARC 170 is sort of a prototype for the X-Wing, but by the time ANH rolls around they have obviously either been phased out or not used by the Alliance. But in its infinite wisdom (obvious sarcasm) I am sure SOE will make the right decision.

Word was going around TC that RotW was going in there as well for open beta. (Just a rumor I heard, nothing I've read from a Dev to confirm it)
The ACR-170 is a 3-person MPS? Not bad! Might be easier to crew that one than try and find all the people needed for the big MPS ships. I would hope that these new ships are like the Firespray, but I'm certain that they will be spread across the three factions in some form or another. It will be interesting to see how it turns out.

Technically rebs never flew a wings in New Hope, they were made shortly before battle of endor, same with the b wing if i remember correctly.

arc is going to be privateer because is a general starfighter
eta-2-"jedistarfighter" is going rebel well because a nickname like that come on.
the bebullba-22 is going imperial because sith are aligned with the empire anyways
also I think there will be a special mission to acquire them. or just be a master ship for thoose professions. I hope its going this way atleast.
