First off Option 2 is the best, it is win/win for all but the elitist who want to block folks from getting thier $30 worth.
But True I thought about this and realized it was BS. If you fly around and do nothing and have no ID that labels you as a Rebel or Imperial then your Neutral, IF YOU ACT NEUTRAL YOU ARE. But fire on an Imperial ship You effectivly declared yourself a rebel and visa versa. I think you should be declared based on who you attack and until you leave the PvP zone, THAT is ROLEPAYING not ROLLPLAYING.
