Whilst not diving in too deeply, you have to admit that the fighters in question have ties to neither faction, therefore it is unfair that they should be separated into them now.
If you really want to get down to it, both the JSF and the ARC were used by the Republic which became the Empire.
By that logic, the Empire would have access to both of these ships and the Rebels would get nothing (from the current lineup of new ships).

Getting one is simply a decision that must be made ingame, like any other. Do I become Jedi? Crafter or Combatant? Rebel or Imperial? Some are harder than others, and some are harder based on previous choice you've made. The limits on JSF access are not inherently unfair, and there's no point in pressing for a change, short of a new expansion with more quests, it's realistically not going to happen.
I don't agree with that at all. The limits are inherently unfair, change is possible.
doesnt quite make sense to have something like the clone armor for all factions and hte ships only for 1.
If anyone wants to say it wouldnt look right with for rebs to have a jsf just look at hte clone armor, if it wasnt for the color they could easily be mistaken as stormtroopers.
Its not like it's going to kill anyone. if anything it will mean less wasted time by dropping and grinding back up jsut to get the ship.
This actually makes it worse to my mind. Surely by this logic only ONE player should have this ship? Unless Vader has a whole fleet of them?

Since we're so interested in the storyline, here's a little spoiler about the JSF given in SWG. It's given to you by Darth Vader, and it's his old ship, so it's perfectly appropriate for the quest to require you to be an Imperial.
Arguments about whether it's "fair" are pointless. Each side has a quest to get a movie ship, and each quest requires you to be a member. That seems fair in my mind. While most people may find the JSF more useful or desirable that's a matter of opinion, not fairness. It just means that the work you need to do to get the ship is more worth it to you in the end, yes? The game is about choices, make the choice to get the ship or not, but trying to argue unfairness when there is none is silly.
