I could accept the pirating of ships, but the taking/acquisition and destroying of ships isnt cool...unless maybe its NPC. Also yu should be limited to how much you can take based on the cargo capacity ofthe pirating ship.

How about some sort of 'cargo management' terminal in freighters, similar to the ones proposed for freighting at starports?
Setting one of those of (smuggler ability) starts a transfer of cargo to the specified target ship (either one docked at the starport or docked with the ship the terminal is on). The transfer takes time and can be reversed by using the terminal on the other ship.
So, say your ship (with you and your loyal guards on it is raided) - the cargo starts being transferred to the other ship - you and your mates could fight your way across the link between the ships, and start stealing cargo from the pirates! 
Mind you, this might be open to griefing people by separating the ships taking someone from the other ship... Then again, I'd find that fun, being 'stranded' on an enemy ship.

If there is abilty to take cargo from other ships, I think a time based auto-transfer system is a must. Basically the "pirate" picks from the freighter inventory what they want provided there is space for iton their ship. Based on mass and volume there is a given amount of time for the transfer(s).
Now I think there should be a required amount of damage/incapacitation of the ship to pirate it, in addition to a possible interior ship defense system that will prevent pirating and/or limit the time available to pirate the ship(based on its level ofproffeincy). I also think smuggler holds/compartments should have variables/modifers that determines the odds of its contents being discovered, shown in inventory and madeavailable to be taken.
No self destructs of other people's ships, but maybe a possibilty of self-destructing one's own ship. It having a very high damage abilty for any ship in range to pirate...basically right next to it. Self-destructing would mean no ship to repair, you'd have to buy and replace it and any itemsremainng in the inventorywould be lost. This also implies that any items in inventory are retrievable from an incapicitated ship.

who said that they need to be for one faction, they could be trade ships for merchant's, artisan's, and other crafers, not as a freaking fighter, they could be the space version of a donkey and a cart

That is a very acceptable start. I will take that for now and be very happy for the time being...though I would like something not so recognizable.
