giving or buying SOE is still implying i have ownership of something![]()
remeber we live in a world in whic J lo insured her butt.. i can insure MY JEDI LOL.
And no if the game dies completely then my items would die too kinda like a virtual armegeddon... or world ending event if a asteroid wiped out america tommorow no insurance company would pay up its a god clause.. soe= Gods they pull plug then wham no rights or ability to sue /wink

Buy providing a medium in which ot "trade" soe implies there is sumthing we the players have in which we can trade for value... This moves the player out of the realm of user to part owener of virtual property..

if players owned and insured thier characters/items then they would hold soe accountable for thier loss once the game dies.
again a enterprising inusrance company would have a natural causes/god clause.. in the even of mas catastrophe's your items would not be protected aa server dying or game dying..
Real life insurance companies have em today alot of coverages dont cover tornadoes hurricanes floods or other "acts" of nature only accidental loss unless u specify and PAY for said coverages and in some cases certain things will never be coverd.. look at the great Fire of chicago one of the few compaines to pay was hartford insurance company .... this kind of GAME insurance protects botht the player and company as long as they keep up their end of the deal buy providing a steady gaming base and popularity (that being there job jsut as its natures to keep a relativley safe and livley enviroment for us to live in ( though we give it a run for its money)).

We buy the game knowing it can be changed at any time. It all comes down to that statement on the back of the box. You buy the game with pryor knowledge.
whew which is why them puttinga REAL value breaks there own Eula the eula protects a game in which the player/customer has 0 real world value and investmen in... making it legal to sell virtual parts opena whoel other can of worms they will have to revise the eula.. but the cant do that legaly for all us old customers.. thats bait and switch

well great. Then insure your character, but that doesn't mean soe can't change it. You would have to insure your character against things unrelated to the fact that soe can change it at any time. You could maybe insure it for the safe exchange of hands during purchasing and stuff like that.
no your not getting it the eula covers gameplay not game items... The paradox is right now there is nothing but gameplay Legaly.. once we can legaly Trade ingame items and accounts and have ownership we break the Eula shield as there is nothing proctecting either party both SOE and the player form any harm caused by this action as the original eula never considerd this action.. and there is no way in well that they can change the eula after so many haev already bought the first one without refunding ALL those who do not wnat to agree to the new one....

you just said the eula doesn't apply to anything other than gameplay. So why would the eula have to extend to this new feature in order for the players to be protected? why can't there by another system in place to protect players with out of game transactions?
Beacuse Not everyone will want to agree to these terms and since nothing in the box or on the box ocvers this.. they could change the box and all new customers wuold bebehind a new eula but they would then have to refund all players who did not want this.. i dont see them doing this... this isa really complicated issue now.. first of its kind.. we shall see how it is handled.. rember the other sites that were selling the items could care less about the game or its players it was truly a neutral medium SOE providing a meidum in which to sell things you create withtin SOE's world is a Crazy thing they will singlehandedly create a virtual country... Rember Evercrack has already proven to have the GDP of russia thru itema nd account sales.. thats some serious cash... that much cash there are gonna be suits on both sides tugging.. SOe will probably try and be sly and just adjust the wording on the eula we click accept on everday loggin in but that wont protect them froma class suit if they can get a trial.. this is of course if something goes BAD after this all goes legal.. aka i bet we wont see another ROTW /cu publish EVER

nope not so SOE cannot deny anyone the right to anyting ingame gamplay or other wise (while still allowing you to log in aka they cannot pick an dchoose what you will do).. they could say you coulndt login if you did not agree but then that would break eula again as the original eula you purchased did not cover this.. trust me this one thing is gonna cause a stir intrested to see how eq2 goes with it...
