It's not an exploit, any more than throwing an AE to hit everyone in a base is on an otherwise legal target.
It's a tactic that I posted here back in November. It's just another example of bad implementation that makes the CM way overpowered.
The duelling to get a legal target thing will never be ruled an exploit. Doing so would be saying that using an AE to hit people other than your primary target is exploiting. If they do rule this an exploit for some stupid reason, all you need to do is have someone log on their rebel alt, position the alt where you want them, have them /declare, & hit everyone anyways.
Yes, it's an overpowered tactic, but so is much of the rest of CM's stuff. (65m+ poisons, AE's ignoring line of sight, CM tossing from water)

shows how much u know since there are certain PA's which not even cm posion can reach
