Thread: Stopping Credit Sellers
Let me ask you this then... What is the difference between paying someone for in game credits, or paying someone to level my character?
"You may not buy, sell or auction (or host or facilitate the ability to allow others to buy, sell or auction) any Account or any Game characters, items, credits or copyrighted material or any other intellectual property owned or controlled by us or our licensors. "
We are talking about a computer game, the only thing that has any true "value" is the time you took to play it.
and by this standard, SOE could sue Ebay... but not the person selling their own effort put into the game

The difference is that one is against the part of the EULA you quoted. The other is against this part... "You may not transfer or share your Account with anyone, except that if you are a parent or guardian, you may permit one child to use the Account instead of you (in which case you may not use that Account)."

We're the people that are now at a disadvantage as a result of steps taken out of game. So, it's not good but you're right, it's not the same as ebay either.
I kind of thought additional accounts were good in part, at least. I thought that others are welcome to keep my monthy fee down by paying double or more. Of course, SWG is almost if not the most expensive MMORPG available right now. That extra money is clearly not going twords the only thing that makes SWG unique so that line of reasoning is kind of shot for me there.

Oh, the logic is sound enough - Even though you are very correct - Our monies DON'T get siphoned to where they would do the modt good. I've gound it strange that with the amiunt of bugs we have that the ONLY response we seem to get is a written "We're looking into it" or Double XP as a salve... But THAT is another discussion entirely.

Particuarly item #2. I think there has been so much rumor about the legality of selling credits that people have developed into an urban myth.

well its more like this point has to be challenged in order to get a decision on this point of law.
in order for that to happen, it must be financially worthwhile to someone to challenge the legal enforceability of this point as it stands in the TOS agreements versus simply getting a new account and continuing to farm credits or sell accounts

Possibly, we already saw the Supreme Court dodge the P2P issue.

What would be the legal argument?
EULA says clearly that we may not buy/sell anything. WE all agree to the EULA. I don't see any good legal arguments that get past this.
Just cause we put our time into something doesn't mean we own stuff.
i'm quite sure that someone could find a way to argue this...if they were properly motivated. thats my point. online game EULAs and TOS agreements have never been challenged. there is limited financial reasons to do so. and the definition of what constitutes virtual property is one way to do that.
i just can't think of a way myself right now.
