just an idea bear with me

make it on a 1 day timer or something

thesmuggler turns it on while incapacitated like force of will, and the little feign death icon comes up to show that its on

as soon as someone deathblows them they receive the message

"smuggler jimmy is no more." no faction points (ive had this happen enough times inGCW pvp eventhat i for one wouldnt question it)

and the smuggler then turns into a corpse on everyones screen, but can keep recharging his hamon his screen, to become unincapped and then regen back up to full ham, while still looking like a corpse

once he presses feign death again, up he pops with whatever ham he had regenned to.

eh? eh?
