I was told that when selling faction the only person that has to be declared is the smuggler...they both have to be standing by the recruiter but only the smuggler has to be declared and that it doesn't matter if the other person isof the same faction or neutral (ex: if the second person is neutral but has - faction points where they use to be the other faction)....could someone tell me if this is true or not?

that's true, you can sell faction to a covert or even neutral player.
On the case of a neutral however i'll be careful about the limit they can hold.
And the smuggler is supposed to perfom this deal while overt.

Thanks man...can the smuggler do this even if the person is in the negitives of the desired faction and bring them up to the 200 entry fee into that faction?

yep. but they cannot be opposing faction. say your client has -5000 imp faction. he resigns from the rebs and comes to you. you can purchase him 5200 imp faction and he will be allowed to join. I do it all the time.

Side note:
Even if your friend is still a covert Rebel, you can still sell him the 5200 points...he just can't join the Empire until he resigns from the Alliance...

Yes, which is why you tend to see posts on the trade forums from people looking to buy 5200 points.
