The bug has to do with terrain as far as I can tell. You may notice it works well inside structures, but not out in the wild. If you test on the flat lands of Tatooine (Mesric Plateau near the middle of the map, or the flat land south of Bestine), you will succeed every time if no npc/critter is close.

You can tell it has failed if the border turns red. If successful, it will not turn red, and possibly offer a system message if you did in fact have a npc/critter too close.

Note: you also need a line of sight to the target to use sniper shot.
