I've read that depending on the space zone status, either the reb or imp npcs in kessel will drop the "good loot".
Two questions:
1) is this even true?
2) if so then how can one tell which side is dropping loot short of shooting them?

1) Kessel, on average, tends to have a better chance of loot than DS. However, there's a downside. Kessel is essentially a graveyard, and most of these "I got it in Kessel" reports come from the days when you couldn't spit sideways more than a few inches without running into a huge cloud of enemies, and those nostalgic stories persist even today, even with Kessel being largely empty. Just speaking in terms of sheer STATISTICS, you have a better chance at looting L10s and other desirable levels in DS due to the sheer AMOUNT of enemies that can be available on a regular basis.
1a) You tend to get better loot [chances] from "harder" targets like Gunboats and NPC-controlled POB targets. It's led me to believe loot is somewhat xp-based, meaning the apparent difficulty of an enemy improves your chances. There's no real way to prove it, however.
2) This sounds like a myth cooked up by someone. The only differences between Rebel/Imperial loot is Imperials will never loot Sienar/Rendili stuff off of Rebel and Miscellaneously-aligned targets. Simply put, you'll never get a Sienar Flight Systems weapon off of an X-Wing.

Reb gunboats in DS are the best way to get lvl 10 weapons I'm pretty sure. In an 80 loot run in DS I have looted as man as 5, but I focus on gunboats and novas.

I seriously have never looted a sienar brand weap, and want to badly. I have trained privateer and imp pilot trees, have a cpl guild halls with hundreds of weapons in them and not one sienar branded weap... I lean torwards calling this fact.

It's a yin-yang thing. Read the back of the new Total Experience strategy guide. There are faction-specific loots.
You will never loot a Sienar weapon off a Neutral/Rebel ship. The only people who have the best of both worlds are TRUE neutral pilots, who can kill both faction's ships.

[note: I agree with what you say on statistical likelihood, the following is just a fun little jab]
Ahhh yeah, the good old days! I was in Kessel once, and looted a 97.9 speed L10 engine. That thing is sweet. I miss those days.... oh, wait. That was last night that happened, my bad
[note: *nod* true story, the thing RE'd out nice too. maybe I could have been more patient for PYR, but she ended up with 82-80-82 and 103.7 speed.]

No way to prove it, but my 22k mass L8engine and 22k mass L8 gun both dropped of a tier 5. Could be programmed but just as easy luck of the draw.
