Not that I'm complaining, just mentioning how it works for me.

If you are unfactioned you have to choose a faction when you go into deep space.
As a Smuggler Alliance Pilot and a rebel on the ground, I am forced to pick rebel when I go into deep space (you have to be covert and talk to the dathomir deep-space station), no other choices.
As a Smuggler Alliance Pilot and a rebel on the ground, I can go to any of the alliance space-stations and declare myself Overt for the space areas. However, if I am overt in space, I need to go to the Dantooine Deep Space Station (the rebel's deep spacestation)to get to Kessel.
If I declare overt at an alliance station, i cannot enter deep space. Being Overt, I cannot talk to the neutral deep space station (in Dathomir). And I cannot get into deep space form the rebel deep space station (in dantooine) because I do not have rebel prestiege points to spend.
Bottom line, Yes. You can delcare at any of the factional space stations and play overt in space. However, if you want to go to deep space, you have to be undeclared, and you will be forced to pick upon entering deepspace.
