We can create loads of other stuff that is copyrighted and trademarked, and that's ok. Why can't we play a damn song from 12 notes?

Its like saying "You can't sell a keyboard because you can recreate copywrited music and sell it at performances"
I don't see whats so wrong with it, its not like people would pay to only make songs on SWG ![]()

It's because Wal-Mart isn't out there suing hundreds of its customers these days for copyright violation.
It's because Wal-Mart doesn't use copyright as a tool to sell songs at unreasonable mark-ups and instead relies on good service and products to attract more customers.
It's because Wal-Mart would be more likely to like free advertising, since its name is generally regarded well, whereas the RIAA can't really use its name as a selling tool.

Actually if you perform a copyrighted song at a public venue you are responsible for paying a license fee for that use. In reality few do when the venue is small or not very visible but you are libel for that fee if caught and may face even larger costs if sued for unlicensed use. I've performed in venues where I would provide mixes of my own dance music from commercial CDs, technically that makes me responsible for the license fee for that public use and if I didn't take care of it the venue could be held libel for it. A band even if they themselfs perform the copyrighted material have a responsiblity to pay the license fee. If some one such as Sony broadcast that copyrighted material they now take on a responsiblity for it and since they are larger, more visible and have deeper pockets they have greater exposure.
