Umm, I think you have this backwards. You HAVE to be overt in Deep Space. It's just that it's an automatic thing for Imp/Reb pilots, but neutrals MUST choose.
Edit: I know this because I was shooting at Rebel aligned neutral pilots last night IN DS.

You are incorrect.
Anyone that enters DS is declared to one side of the faction or the other, but if you don't declare at an Imperial space station bfore going into Deep Space, you don't get faction off the kills....thus a declared Imperial in DS gets faction and is in PVP. An Imperial that is not declared beforehand is still open to PVP and can still attack the Rebel ships, but they get no FP from the kills. It is the latter (getting FP in DS) that a privateer can not do.
There are 2 switches that must be thrown to get FP in DS. One is declaring your faction, the other is declaring PVP when you go into DS. Privateers can not throw that last switch when the first one is thrown.
