Can I declare, going into deep space or kessel and gain faction points from the kills?

Yes you can, you actually must choose a side when you go to Deep Space. But it is better to do that in kessel, cuz not everyone runs around overt by default in there

I'm already Imperial ace and usually have no problems in Deep Space, I declare for faction and doesn't matter since Deep Space is pvp automatically.
My alt on the same server is going to master Rebel Pilot (4333 now) and switch to Imperial and go freelance. (Since I'm already Imperial ace, don't like the ships too much, and I want to try something else)

Just a question here. I see that I have to do the jabba themepark just to start my tier 3 missions. I dotn want to do the themepark.. Do the other two freelance (factions?) make you go to jabba's palace as well?? If so, guess I'll get to the jabba faction.

You may not have to do the Theme Park, take a look at the "How do I land at..." thread on the front page here.

do the tatooine space station missions and you can land at jabba's palace and enter the throne room.

Yes it was changed so you don't have to do the themepark anymore. Just do the missions from Tat station as was suggested earlier. However the themeparks are actually kind of fun, and you get a few nice decorations for your house.
