All good theories but I am not certain. First off I put the crystal in the bank and dont have it on me- not sure if that matters. 2nd- I did get attacked a second time all by myself just seconds after I buffed myself and went to dant to grind- I defeated both sith and and did not loot them until after they were dead. I got another waypoint datapad thing and it too was not able to be read. So I it should not matter if you are CL80 or not.. it is very possible to defeat the sith at cl60 like I did- I was not buffed the first time I was attacked and did not think to buff myself because it happened so quickly.
Any I opend a csr ticket and they told me the sith will just keep attacking until I get a waypoint thing that works.

So let me get this straight. After several bugged discs and after now being confident you can take the Shadows on your own, the thought of taking the crystal out of the bank has yet to cross your mind? 
Come on, just go put it in your inventory again, you know you want to.
Also, and this is not directed to you, why are people assuming that not being cl 80 means you are trying to get FS too -early-? Isn't that a bit like assuming that all the combat template characters are simply to "new" to have been able to become a master crafter yet? Both assumtions are similar to toasting your bread while in the bath with the toaster carefully balanced on the edge of the tub, i.e. - a sign that special aid classes might have been involved during childhood.
( P.S ) What happened to me was when the old man came he gave me crystal it said and it didn't show up in my inventory and I send in Customer Service Tickets and they responded saying do the system so I did and even though the crystal didn't show up, the sith did and when I killed them I got the waypoint and it worked even with an invisible crystal hehe and when I got to the village the Village Elder gives you a new one everytime if you lose one, also be sure to make a waypoint ( second one ) of the village because the datapad explodes, and something like on my first time on my mission the waypoint in the datapad stops going and disappears so be sure to make a waypoint of that.
Also your on the easy part, you think old man system is annoying hard and rigges, man you have something coming on the village missions and the millions upon millions of expierience you need to convert 3-1 is the ratio into Force Sensitive expierience...

I forgot about the crystal to be honest - The old man said to keep it safe - where else is more secure than the safety deposit box at the bank?
Anyhow I finallygot the crystal from the bank after the 2nd time the sith showed up. I just got the old man again and now I am waiting for the sith shadows to show up again with the cyrstal in my inventory- I tried using the waypoint datapad but it now says "you must loot this item before you can extract any information out of it" so as directed to do so by CSR I am destroying the broken waypoint and waiting for the siths shadows again. When they show up I'll have the crystal in inventory and hopefully when I defeat them I will get a working waypoint datapad. If not, then I will have to open up a new CSR ticket because I have no idea what to do. Their original response was to just keep killing sith until eventually I get a working waypoint.
I am just waiting for the Sith to show up again now with the original crystal in my inventory - hopefully this time it will be usable. I have seen the old may 3 or maybe now 4 days in a row. All I wanted to do was get this old man to come so I can start the village and now I shutter when I see him again because I am stuck in a loop!

That's how I did it.
My wp kept spawning inside a building in a NPC city. I hope yours works ok when you finally get to use it.

Good news is that on the Test Centre Notes, that exact error has been fixed. Goes live tomorrow as far as I know (along with the 200 new bugs)
