Yes you can. Be sure to at them atleast once, to ensure you get credit for the kill.

OMG... I remember when they attacked me... Pre-CU these guys were 500 HAM pushovers... I don't even think I hit them and they died. If they are lvl 75-77 that is a drastic change for sure.

Let me give you an update. I was on my way to get a battle droid (which I found out later will not help in fighting these Siths). I get off my swoop outside the vendor tent and **BAMM** they spawn and start shooting at me. I start running for cover inside the tent, just get inside and I am incapped. I wake up and they are still standing outside. I email my guild members for help. They are not attacking me while I'm inside the tent. My friends come to rescue me, we kill the two Siths (actually I got 1 hit on the 2nd Sith and he went down). I looted them, got a data pad, but it was unreadable. 
I check my inventory...My crystal is gone!!! Those B*****rds took the crystal when I was incapped.
The old man has since revisited me and gave me another crystal...I only hope I am with a group when they surprise attack me again.
