Thread: Do we have a case?

I guess one could argue they embezzled money. After all hardcore CH's are waiting for the promised combat revamp. It is in good faith we pay our fees expecting fixes. Instead we pay for development of some expansion that has nothing to do with us whatsoever.

embezzle \Em*bez"zle\,
v. t. [imp. & p. p. Embezzled; p. pr. & vb. n. Embezzling.] [Norm. F. embeseiller to destroy; cf. OF. besillier to ill treat, ravage, destroy. Cf. Bezzle.]
1. To appropriate fraudulently to one's own use, as property intrusted to one's care; to apply to one's private uses by a breach of trust; as, to embezzle money held in trust.
From www.dictionary.com

WHAT IS THE DIFFERENCE BETWEEN LARCENY AND EMBEZZLEMENT?

The major difference between larceny and embezzlement is the way in which the property changes hands. With larceny, the property is carried away; it was never in the possession of the perpetrator. With embezzlement, however, the perpetrator has lawfully possessed the property, but then has converted it into his/her own property.

The following example illustrates the difference. A man walks onto a construction site and takes a hammer and goes home. He has committed larceny, because he has taken someone else’s property away, with the intent never to return it.

A construction worker on that same site, who uses the hammer every day, puts it in his pocket at the end of the day and takes it home. He has committed embezzlement, because it was in his possession to use while he worked on the site, but when he took it off the site, he converted it into his own property. http://criminal-law.freeadvice.com/white_collar_crimes/embezzlement_larceny.htm

As I see it, SWG Devs have taken what they were supposed to guarding. They are in possession of the game by law. But since it is our game and we trusted them to Develop it in a better manner, they have indeed taken the game and made it their personal property witout heeding the customer. But let's take it one step further. If everyone went out and bought one share of stock, then it makes it our property and the legalese becomes more valid because not only are we customers but owners.

To hammer this point home, a business owner once drew money out of his business account to finance renovations for his personal home. He was convicted for embezzling although both the business and his home were both his personal properties. The difference is that a corporation is protected as its own entity. The state will persecute for the corporation as an Entity.

SOE is a corporation and has the right to be protected from such fraudulent behavoir as mismanagement of funds. Funds that we consumers trust to be used appropriately to fix bugs, make the timely combat revamp which is 6 months overdue according to estimates given CH's.

Ah, however, while Jump to Lightspeed requires an additional purchase, it is founded upon and requires the core game of SWG:AED. Further, while the teams are not focusing on the same thing, they are not entirely separate either as they eventually report to the same person higher up the chain.

I am also not aware of any clause that says all funds from SWG:AED will be put towards further development on said property. They do support it, just not to the extent we led to believe.

So no, we do not have a case, if you mean a legal case. At worst they have been negligent and mishandled their resources. It would be safe to say our trust has been taken for granted and could not argue with anyone says that what has been done to us is unethical.

No we do not. Reading the EULA finds one or more statements that make this clear

Neither this Agreement nor your Account entitles you to any subsequent releases of the Game and/or the Software, any expansion packs nor similar ancillary products. You understand that we may update or otherwise enhance the Game and/or the Software at any time and in doing so incur no obligation to furnish such updates to you pursuant to this Agreement. You understand that online games evolve over time and, accordingly, system requirements to play the Game may change over time.

"in doing so incur no obligation to furnish such updates to you" so they can do updates or not. Tell us or not. Give it to us or not. Charge us or not.

We get for our subscription the oppertunity to play the game. We have to buy several tools to play the game. Those tools include but are not limited to internet access, computer, client (the softwere we install on our machines). No where does the aggrement promise to use the subscription fees nor the funds for purchased software for any purpose at all and clearly states that this agreement and our account does NOT entitle us to do any more than play the game as long as SOE wants to let us. We do however have the right to vote with our feet as it were.

Might wanna always read the EULA , SOE has there right to do with the game as they wish if that does include ch fixes or not wich alot wish would happen . If for some reason your not really happy with things and how it's looking so far , every paid customer has there right to stop playing SWG. Alot thoe wish to remain in with the game in for long as they can to see changes to there prof could be CH or any other for the most part.

Duh? I have 4 days left on this gamecard. I may or may not be back to check on things after the Combat Rebalance is in place but certainly not before then.

I've been watching since release for things to happen and most of the stuff that has happened has been good but most of the stuff that has been promised would happen would have been better.

Sony Corporation (ADR)
Quotes delayed 20 minutes Quick Quote Detailed Quote
Last 36.00
Change(%) +0.29 (+0.81%)
High 36.15
Low 35.81
Volume 384,700

If 200K+ people bought a share of sony stock tomorrow at 36 bucks each instead of buying JTL I would almost be certain would could force a change. Yeah, I am talking hostile takeover.

200K stocks in a conglomerate by proxy we would control 33% of Sony.

We paid SOE in good faith for a year of service which included gameplay, continued development and fixes.

Those funds were diverted into the creation of a new product rather than into the service we were paying them to give us.

We're the bottom rung of a sort of pyramid scheme. We paid money for JTL to pull in new customers to replace the old customers who finally realize they're being screwed and pull out.
