ok found the problem with patch 8 
creatures although now follow properly have a tendency to despawn this happened to me in the middle of a fight lucky it was only hermits outside mos espa on my way home! and a friend of mine had his dissapere every 5 min while we were hunting janta on dant but mine seemed ok that trip

This problem's actually been around for quite a while longer, you were just lucky enough not to hae it happen to you before. I think that the creature's CL may have something to do with it's frequency of despawning though....I never have trouble with creatures that are level 24 or lower.
