Thread: eBay Jedi: a College Report

I'm doing an analyticalreport for my Technical Writing college class on the buying and selling of virtual goods. I'm doing itwith the context of me working for SOE and giving a recommendation on what they should do about the many auctions and other trading of SWG items (accounts, credits, etc.)


I'd like to have people's opinions on the matter, and I would appreciate any resources anyone has on hand on the matter.

Are you asking us to do your college report?


I was going to do the same thing for a Econ class, but was told that a report on E-trade stock sales.

Well, simply google 'buy SWG credits', and you will have atleast 5 different sites that pop up, offering credits. Personally, I think its stupid. However, some people get so into their virtual persona that these things become more important. /shrug

Well first what is going to be your recommendation? I think that it is important to first set out a specific goal. If it changes in the end or you were wrong, then all the better, it gives you more material to write about.

Second: Based on this inital recommendation, how do you propose to implement it, and what effects both positive and negative will this have on the game itself.

Third: The root question in all of this is how are third party companies (ebay, credit\item sellers) able to provide this service. Obviously there is a market for this stuff or else it would not be happening to the extent that we see it. So should SOE take the "high road" and continue to "ignore" this aspect of the game and continue to allow these third party transactions to take place or should they try to get into the market themselves by implementing an auction system inside the game.


This is just an example, but it is important to go into a situation that you will be writing about with as many question and specific concepts as possible. That way you know what to look for, and will in the long run make writing this paper much easier.

Just my 2 cents, and good luck with the paper.

first of all. i dont really believe that buying or trading accounts/credits/items to be ethical or legal since you are makeing a profit off of sony and not paying any royalties to them besides the money payed for the account. that being said, most money now days is virtual, as money can be made and lost without ever actually having a tangible item.one book that i have read that really puts this into perspective is "Rich dad Poor dad". cant really remember who it was by but it was much better at explaining how money works in todays ecology with its "virtual" aspects. i know that i have probably made things as clear as mud but that book might give you some good material.

One of reasons I keep hearing for why this practice is condemned is that it violates the intellectual property rights of the game owners. I am not sure I buy this argument. By e-baying characters or credits you are not altering the intellectual property and you are certainly not claiming that it is your creation.

SOE may claim (and perhaps rightly so) that it should have control over how their intellectual property is used, but that is not an IP issue. Controlling the use of our product is an altogether more nebulous issue. For a "real world" example, we can look to the publishing industry: Used book sales seriously curtail the profitability of publishing houses. It is a major factor in the obscene prices on textbooks and the frequent editioning of the very same material. Despite the damage inflicted by this parasitic (depending on your point of view) industry why is it still allowed to continue? Could not a publishing house develop a type of EULA and explicitly prohibit the resale of used books? I suspect that if it was a defensible position it would have occured a while ago.

This brings us the the crux of the E-baying issue. For some reason, consumers of computer hardware and software have accepted that the things we purchase are not our own. Just because it runs on our computer we can't exchange a faulty (or ill-conceived) product, we accept increasingly tyrannical and invasive EULAs; these are things we would never accept when buying a cup of coffee, or a stove or a car.

I don't know how I feel about this issue, but I hope that my 2 cents will encourage more discussion along these lines.

If I was in your situation, I'd start by doing some research on Yantis and IGE. What Yantis did to EQ and what's SOE's reaction was set the tone for sales of virtual goods.


What you'll find is that the practices that SOE rallied against Yantis for were very different from the generic credit / Jedi sales we see in SWG. Yantis had "employees" camping static spawns 24/7 - in some situations, if you wanted a certain item and you played on a server that Yantis was established on, the only way to get it was to actually purchase it from him with real world dollars.


That kind of behavior can be directly proven to be disruptive to the gameplay of other customers, and it's why I feel SOE really went after them. That said, the sale of credits and Jedi cannot be proven to be directly disruptive to other customers' play in the same way (you've always got other means of aquiring a Jedi account or credits).


I've sold virtual money in other MMOG's where it was not a violation of the ToS / EULA. The vast majority of the people who bought from me were simply folks with more money than spare time - people with hectic careers, in the military, etc. They weren't looking to gain a leg up on people, they just didn't want to spend what scant time they had in game grinding out money. I can't say I blame them- if a one-time purchase of $20 worth of credits keeps you off of the mission terminals and doing what you want to do for a few months, isn't it worth it?


I know people like to think that the Ebay buyers are primarily the "leet dewds" using real money to move even further ahead, but in my experience, they're not. Some others like to complain that they don't think real life advantage should have an impact on the game, but to counter that I simply point out that having hours and hours every day to play is certainly a real life advantage over someone who simply doesn't have that kind of free time. Basically, time = money, some people have more of one than the other, and Ebay is a means of exchange between those two resources.

First some thesis:


First my personal Resetgun's-communism-socialism-controlthesis from external markets:
a) It is not fun to play with high-level noobs, who don't know how to walk from point A to point B.
b) Because it will raise item prices in player economy - and thus I need to do more "work" to buy items from other players.
c) Those who have enough money in real life - also have enough money in virtual life... and those who don't have enough money in real life... (I don't want to be poor in virtual life - it should be escape from reality.)
d) High level and other high level itemsarestatus symbols that should be earned, not something that you can buy from nearest eBay reseller.


What shouldSOEdo to make Resetgun's party happy?



  1. Update EULA so that others than lawyers understand what is allowed and what is not (make it much shorter...).

  2. Credit and item trading


    1. Buy credits and items from external markets (for example IGE and eBay)

    2. Ban permamentally sellers accounts

    3. Trace banned accounts large and repeative money or item transfer(s), and permamentally ban collaborators

    4. Publish weekly how many accounts have banned (no names given)

  3. Account trading


    1. Monitor credit card information

    2. If credit card holder's name and location is changed ban player permamentally, because of account trading.

    3. Publish weekly how many acounts have banned (no names given)

Then second "narcissist-invidualism"thesis counter attacking against Resetgun's arguments:
a) You have that even when they aren't account buyers.
b)If alot of it is sold. Prices go down. Saturation. Way the market works.
c) Who cares?
d) Some would say the same for wealth. But lets face it. Some get lucky, some get it inherited. Money is power. And power can almost get you everything.


What shouldSOEdo to make narcissist-invidualism party happy?



  1. Update EULA so that credit and item trading would be allowed

  2. Credit and item trading - do nothing

  3. Account trading: Implement service that allow people transfer characters to another account with a small fee.

Andfinally greedy-corporation/customer-safetythesis:
There is customers that are willingly to pay from virtual money. However currently this market is owned by third party corporations andinviduals. It is also risky for customer to buy from theseagents, because of possibility of scamming.


1. Update EULA so that only SOE can sell these virtual goods
2. Implement marketplace where SOE can sell credits, itemsand "pre-leveled" characters for customers. There couldalso be non-tradable items that are only available for customers here.
3. Close markets from 3rd party corporations and inviduals. Use ban stick to anything suspicious.


Syntehesis: Realistic SOE viewpoint


- If youimplement Resetgun's-communis-socialism-control partysuggestions you will lose customers, because some people don't want to grind and earn their status ingame. Also it would cost money to implement suggestions (you need budget to buy items/credits/accounts and hire at least one person to enforce rules).
- If you follow narcissist-invidualism suggestions you will lose customers from Resetgun's-communism-socialism-control party (you might actually lose more people, bacause Resetgun's party members are well know fanatics). Character transfer service might bring some income, but not enough to compensate.
- If you do greedy-corporation/customer-safety suggestion, you will lose players from both parties and you would get bad publicity from both parties. You would get some income from services, but most likely you would lose more. Also montly subscription payment would come under mutiny.

Do nothing. All choices seem to lead losing customers, money and bad publicity. Deny existency of the problem. Deny existence of possible research papers from subjects. Do not give any information to public.

We may also terminate this Agreement if we decide, in our sole discretion, to discontinue offering the Game, in which case we may provide you with a prorated refund of any prepaid amounts.


7. You acknowledge that you are bound by the terms and conditions of the Software License and Limited Warranty that accompanies the Game. You acknowledge and agree that you have not and will not acquire or obtain any intellectual property or other rights, including any right of exploitation, of any kind in or to the software, artwork, music, and other components included in the accompanying CD-ROM (the “Software”) or the Game, including, without limitation, in any character(s), item(s), credit(s) or other material or property. You may not use any third party software to modify the Software or to change game play. You may not create, facilitate, host, link to or provide any other means through which the Game may be played by others, such as through server emulators; additionally, you may not engage in matchmaking for multi-player play over unauthorized networks. You may not decrypt or modify any data transmitted between client and server; you may not use or distribute macros or other programs which would allow unattended game play or which otherwise impact game play. You may not take any action which imposes an unreasonable or disproportionately large load (as determined by us) on our infrastructure. You may not buy, sell or auction (or host or facilitate the ability to allow others to buy, sell or auction) any Account or any Game characters, items, credits or copyrighted material or any other intellectual property owned or controlled by us or our licensors without first obtaining our express written permission.


8. As part of your Account, you can upload content to our servers in various forms, such as in the selections you make for the Game, in-game posts and chat, and in chat rooms and similar user-to-user areas (collectively, your "Content"). If we, or our licensors, can reasonably construe that your Content contains any material that infringes any of our respective or collective intellectual property interests (hereafter, such Content shall be referred to as “Derivative Content”), you hereby acknowledge and agree that any such Derivative Content is owned by our licensors or us. For any of your Content that is not a Derivative Content, you hereby exclusively grant and irrevocably assign to our licensors and us all rights of any kind or nature throughout the universe to such Content (including all ancillary and subsidiary rights thereto which include, without limitation, merchandising and interactive media rights) in any languages and media now known or not currently known. To the extent that any of the rights assigned herein cannot presently be assigned under applicable law, you hereby exclusively grant to our licensors and us a universal, perpetual, irrevocable, royalty-free, sublicenseable (through multiple tiers) right to exercise all rights of any kind or nature associated with your Content, and all ancillary and subsidiary rights thereto, in any languages and media now known or not currently known. 9. We cannot ensure that your private communications and other personally identifiable information will not be disclosed to third parties. Additionally, we can (and you authorize us to) disclose any information about you to private entities, law enforcement or other government officials as we, in our sole discretion, believe necessary or appropriate to investigate or resolve possible problems or inquiries. You acknowledge and agree that we may transfer such information (including, without limitation your personally identifiable information or personal data) to the United States or other countries or may share such information with our licensees and agents in connection with the Game. Furthermore, if you request any technical support, you consent to our remote accessing and review of the computer you load the Software onto for purposes of support and debugging. You agree that we may communicate with you via email and any similar technology for any purpose relating to the Game, the Software and any services or software which may in the future be provided by us or on our behalf. You may choose to visit www.station.sony.com (“The Station”), SOE’s web site, if The Station offers services such as a Game themed chat room or other services of interest to you. You are subject to the terms and conditions, privacy customs and policies of SOE while on The Station. Since we do not control other web sites and/or privacy policies of third parties, different rules may apply to their use or disclosure of the personal information you disclose to others. Solely for the purpose of patching and updating the Game and/or the Software and ensuring the integrity of the Game, you hereby grant us permission to: (i) upload Game related file information and data from your computer; and (ii) download Game files to you. You acknowledge that any and all character data is stored and is resident on our servers, and any and all communications that you make within the Game (including, but not limited to, messages solely directed at another player or group of players) traverse through our servers, may or may not be monitored by us or our agents, you have no expectation of privacy in any such communications and expressly consent to such monitoring of communications you send and receive.


10. SOE EXPRESSLY DISCLAIMS ALL WARRANTIES OR CONDITIONS OF ANY KIND, EXPRESS, IMPLIED OR STATUTORY, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF TITLE, NONINFRINGEMENT, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT SHALL SOE, ITS LICENSORS, THEIR PARENTS OR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS BE LIABLE TO YOU OR TO ANY THIRD PARTY FOR ANY LOST PROFITS OR SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES (HOWEVER ARISING, INCLUDING NEGLIGENCE) ARISING OUT OF OR IN CONNECTION WITH YOUR ACCOUNT, THE SOFTWARE, THE GAME OR THIS AGREEMENT INCLUDING, WITHOUT LIMITATION, DAMAGE TO PROPERTY AND – TO THE EXTENT PERMITTED BY APPLICABLE LAW – DAMAGES FOR PERSONAL INJURY, EVEN IF SOE, ITS LICENSORS OR THEIR PARENTS OR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR LOSS. THE LIABILITY OF SOE, ITS LICENSORS OR ANY OF THEIR PARENT OR AFFILIATED COMPANIES TO YOU OR ANY THIRD PARTIES IS LIMITED TO $100. YOU AGREE TO WAIVE ANY RIGHT TO EQUITABLE RELIEF INCLUDING, WITHOUT LIMITATION, INJUNCTIVE RELIEF AGAINST SOE, ITS LICENSORS, THEIR PARENTS OR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS TO ENFORCE THE TERMS HEREOF; HOWEVER, THE FOREGOING SHALL NOT PRECLUDE SOE AND/OR ITS LICENSORS FROM SEEKING ANY INJUNCTIVE RELIEF. SOME STATES DO NOT ALLOW THE FOREGOING LIMITATIONS OF LIABILITY, SO THEY MAY NOT APPLY TO YOU.


13. You shall comply with all applicable laws regarding your use of the Software, your access to your Account and your playing of the Game. Without limiting the foregoing, you may not download, use or otherwise export or re-export the Software except in full compliance with all applicable laws and regulations.


14. This Agreement is governed in all respects by the laws of the State of California as such laws are applied to agreements entered into and to be performed entirely within California between California residents. The UN Convention on Contracts for the International Sale of Goods is expressly disclaimed. You and SOE all submit to personal jurisdiction in California and further agree that any cause of action relating to this Agreement, your Account and/or the Game shall be brought and maintained in a court in San Diego County, California or, at SOE’s option, in the state courts located within the County of Marin, State of California or the federal courts of the Northern District of California, and you waive any claim that either such forum is inconvenient. If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches. You may not assign or transfer this Agreement or your rights hereunder, and any attempt to the contrary is void. This Agreement sets forth the entire understanding and agreement between you and SOE with respect to the subject matter hereof. Except as provided herein, this Agreement may not be amended except in a writing signed by both parties.

Okay I posted the EULA as it is currently in my post before this one, I posted it seperate from my comments because I wasn't sure how many characters you could post in one post.


Each section of the EULA was developed to either protect SOE or to protect the consumer or both.


Section 1 establishes that each copy of the game can be used only by a sole person.


Section 2: Establishes in conjunction with Section 7 what is needed to play the game.


Section 3: Allows SOE to amend the EULA at any time it sees fit.


Section 4: Informs you that you will need to chose a name, and password. That you cannot chose a login name that violates the intelectual properties owned by others. It also informs you that you cannot share your password with anyone. ( By stating you cannot use names that are the intellectual property of others...including names from other science fiction, movies, etc they are protecting themselves from being sued if you use such a name. )


Section 5: Establishes how you will pay for the account.


Section 6: Establishes how SOE may terminate the account.


Section 7: Establishes the only way recognized by SOE as purchasing the game as actually buying the game from a retailer. Resellers are not allowed. ( The reason this also protects SOE if in some future case the original owner decides they won't the game back...along with the account. )


Section 8: Establishes that you cannot infringe upon the rights of others in game. THis includes naming one's character after a popular character from a movie. The reason for this is to protect SOE from lawsuits, it also helps protect the user from retaliation so long as they abide by these rules. It also establishes good sense naming to avoid other possible lawsuits from parents or others whose sensibilities might be damaged by a name you chose.


Section 9: They keep a record of all ingame communications. If such is requested by third parties in either their or their customers pursuits, SOE reserves the rights to allow them access to such communications.


Section 10: Basically a standard statement, as noted some states in the United States do not allow such disclaimers.


Section 11: This is a statement that protects them from lawsuits should someone place a worm virus in the servers, should a bug cause the servers to go down or for anything which might prevent you from playing on a given day. It also protects them from suits in the event that by some computer glitch or problem your character ( or even server ) was wiped.


Section 12: This basically ensures they don't have to pay for your computer if some malignant virus is downloaded to it from the game. ( best to keep your firewall up )


Section 13: Basically somewhat redundant with some other sections but stated a bit more plainly. you cannot download, decode or transmit any part of the game.


Section 14: Established that if something was to go to trial you would need to submit to the laws of California and establishes where such proceedings would take place. It also voids any transfer or account etc to anyone other than the original user.
