I agree. It's not a good idea.
A good chunk of the venom between BH and Jedi stems from exp loss.
"Easy enough to fix", you say. "Smugglers wouldn't get exp loss under that system".
Ok, so...what's to stop them from being farmed? BH shows up, "hey you're worth 100k. Split it 50/50?"
Smuggler, being no fool, says "Sure, why not?" and pockets his 50k.
What's going to prevent a smuggler from doing this?
