They had to put it into the code because until that point BHs could /duel a Jedi and then attack to get the BH TEF, and the Jedi could not attack back unless he also /dueled the BH first.
Sure, this could have been fixed in a better way, but the previous exploit was far worse and I am happy that that one got fixed, no matter how it got fixed.
