I refer you to the UK Sales of Goods Act for my purchase of TOOW on 2 character accounts, and the imminent change to the game that is coming, known as NGE.



With respect to the fact that a) TOOW was mis-sold through misleading advertising and b) The game is due to change in such a fundamental way when knowingly 1) SOE have known for a long time of these changes and 2) not informed me before taking my subscription from me I hereby formally ask for compensation.



I do not require a refund in full, as I am acting in good faith. I will gladly accept a refund of 50% for TOOW (on both my accounts) and my next month(s) subscription(s) for free while you iron out these problems for NGE unless of course the November 15th date is moved or shelved entirely.



Now you may ask why I posted this here.



Simple



1. No answers from 2 CSR tickets


2. No answers from LIVE support


3. No answers from Tiggs and TH personal e-mail on my issue as stated above.



Please note:



Before responding I suggest you consult the UK Sales of Goods act - which clearly states that:



1. Goods must be sold as advertised. Clearly this was not the case with TOOW as you already knew that CH was going to be taken out of the game through planning for NGE and that many quest rewards will become useless.



2. NGE when it goes live, if as it is now (5 days time) clearly and utterly broken, I would contest that it is not fit for the purpose on which it is being sold (i.e. my monthly subscription).

I'm getting to the point where I'm probably going to cancel my accounts. I'm going to give SOE one month (since I'm on a month-by-month basis) to impress me with the NGE. Otherwise, I'm quitting.


I like your route, too, but unfortunately, it probably won't make any difference to SOE. The obviously didn't give a **edit** about the gamer's opinions when they made the NGE.


And, Julio made a very dumb mistake by going on record originally by first saying that SWG has things other games don't, you can change professions, etc., and that's what separates it from other MMORPGs. Then came this DOWNgrade.

Whilst I am deffinately on yourside in this matter, I am not sure if you can get compensation due to the way the EULA states gaming experience can change. Therefore at the time of sale the agreement / terms were perfectly valid. Technically you agree to the EULA everytime you press OK and log onto the server.


I will watch this space to see if any "red" will post their views on the matter, althought to be honest it is doubtful they will enter a legal debate regarding their products on these boards.

Wildman Solo has a very valid point; What he points out is stated very clearly on all the SWG boxes I have. That game experience may change.

Legal path to compensation is a no go if you read the terms of agreement very carefully. Too bad SOE/LA isn't as efficent as their legal team.

Actually under UK law that little phrase may not be enough to totally cover advertisements of the expansion then the sudden change. They operate by common law over in England. Meaning letter does not always apply.

From every solicitor I have spoken to they have broken UK sales laws for false advertising....


And I am still awaiting a response to this. (I also emailed a select few 'red-names' direct with my query as I stated.


So, if you game producers / developers continue to ignore me there are avenues that I will follow and websites I will contact / send details that may like to take an interest in this.


To name a few:


BBC Watchdog


TheRegister


UK Trading Standards


You can't just cover this up with the EULA as I have already stated - SOE knew about NGE well before the release date of the TOOW and offered / advertised promises that do not hold up to scrutiny after purchase.

Forget threating them, just go to BBC Watchdog. Televised bad publicity is very bad for revenues. That's if they really think you go a case tho.
